@UncleVinny They put tape on the lid so it isn’t an open container! Also they’re all over the state. Northern Louisiana isn’t as laissez faire when it comes to alcohol sales (liquor can’t be sold in a grocery or gas station) but no one gives a damn about driving around with a 32oz styrofoam cup of booze.
@mike808 I dunno but the handgrenades on in the French Quarter type area are awesome. Also the coffee and the beignets. Also the jazz and the street buskers.
“Motor vehicle” means a vehicle driven or drawn by mechanical power and manufactured primarily for use on public highways.
“Open alcoholic beverage container” means any bottle, can, or other receptacle that contains any amount of alcoholic beverage and to which any of the following is applicable: (i) It is open or has a broken seal. (ii) Its contents have been partially removed. “Open alcoholic beverage container” shall not mean any bottle, can, or other receptacle that contains any amount of frozen alcoholic beverage unless the lid is removed or a straw protrudes through the lid.
“Passenger area” means the area designed to seat the driver and passengers while the motor vehicle is in operation and any area that is readily accessible to the driver or a passenger while in their seating positions, including the glove compartment. It shall not mean a locked glove compartment or behind the last upright seat, or any area not normally occupied by the driver or a passenger in a motor vehicle that is not equipped with a trunk.
IANAL: but that straw hole looks like it’s not perfectly sealed. If you tip the cup upside down, it might leak and could then be considered an open container.

So I guess they could go tape-free but it’s a security measure to keep the lid from popping off.
@cengland0 The part I quoted overrides that. If it is a frozen drink that has a lid and does not have a straw, then it is not an open container, regardless of whether or not it has a straw hole. You can write a letter to the king of cajun police if you want but there are more drive-through daquiri places than Starbucks so clearly the law works out.
@Moose the tape probably constitutes it having been sealed by the ‘manufacturer’ absolving them of any legal liability should you then choose to break the seal and consume while driving. (IANAL)

@Pantheist That cowboy reminds me of the Blue’s Clues guy, and the Blue’s Clues guy isn’t creepy to the best of my knowledge.

@therealjrn I knew that was coming, but i didn’t prepare an image.

@RiotDemon I’ve been told you can buy margaritas at drive-thrus in New Orleans. That’d be an unwise Louisiana purchase.
@UncleVinny It’s Drive Thru Daquiris.

N’awlins, baby. True Dat.
@mike808 Damnit, I just got back from campus visiting LSU, and flew through MSY. I could have driven through here!

Louisiana Open container laws:
It is illegal for the vehicle operator to be in possession of an alcoholic beverage in the passenger area of a motor vehicle according to LSA 32:300. https://law.justia.com/codes/louisiana/2011/rs/title32/rs32-300
To summarize:
“Alcoholic beverage” means any of the following: (a) Beer, ale, etc. containing one-half of one percent or more of alcohol by volume, brewed or produced from malt, wholly or in part (b) Wine of not less than one-half of one percent of alcohol by volume. © Distilled spirits which is that substance known as ethyl alcohol, ethanol, or spirits of wine in any form, including all dilutions and mixtures thereof from whatever source or by whatever process produced.

@cengland0 From what you just quoted:
So I guess they could go tape-free but it’s a security measure to keep the lid from popping off.
@Moose You missed this:
The straw hole might be considered a broken seal. I doubt it would be air-tight with that hole.
@cengland0 The part I quoted overrides that. If it is a frozen drink that has a lid and does not have a straw, then it is not an open container, regardless of whether or not it has a straw hole. Why do people keep bringing their private butt stuff into this conversation
@Moose I’m not sure if you’re joking or unfamiliar with the acronym… text is hard
@cengland0 You could poke a hole in the side of the easily pierced styrofoam cup and shotgun it without breaking that law.
