I have a 2013 Jetta TDI, they actually sent me a recall notice a couple months before everything went down. They weren't specific, just "generic ECU update for emissions", so they were already scrambling to fix it before they were caught. My car has the new ECU software, so it has the legal emissions. If you get one from a VW dealer, it will also have the legal ECU software. I didn't notice any drop in performance, TDI still kicks ass compared to any other "efficient" vehicle. I drove from Boston to Philly without filling up at all.

Get it now before the reformat and the used price goes up.
If you don't feel bad about adding extra emissions to the atmosphere, with the diesel models.
